HC-KAR NC: 2026:KHC:6172 CA No. 16 of 2026 IN CA No. 164 of 1997 IN COP No. 82 of 1989
29.02.2024, it had been directed that his name be deleted. This confusion having persisted on account of one other counsel, namely, Sri.Pramoda.R., making a submission that he would be appearing for Respondent No.2, this Court, vide order dated 13.11.2025 had called upon the earlier counsel to make a submission as to who would be appearing for Respondent No.2, when he had indicated that he would not be appearing for Respondent No.2 on
06.12.2025.
6. In that view of the matter, I am of the considered opinion that C.A.No.16 of 2026 filed under Section 72 of the Bharatiya Nyaya Suraksha Sanhita, 2023 is liable to be allowed.
7. Registry is directed to indicate the name of the
learned counsel, Sri.J.M.Anilkumar as that of appearing for Respondent No.2 in the cause-list.
