For Petitioner(s): Ms.G.Bhuvaneswari (Party-in-Person) For Respondent(s): Mr.M.Mohamed Riyaz Government Advocate (Criminal Side) for R1 ORDER This Criminal Original Petition has been filed seeking to call for the records pertaining to Crime No.396 of 2024 on the file of the Ponneri Police Station, Thiruvallur District, and to quash the same. The case has been registered for the offences under Sections 294(b), 323, 324, 506(2) IPC read with Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002. 2. The first petitioner appeared as party-in-person and advanced arguments. I also heard the learned Government Advocate (Criminal Side) appearing for the first respondent. 3. When the matter was taken up for hearing, the learned Government Advocate (Criminal Side) submitted that the investigation in the above crime has already been completed and a final report / charge sheet has been filed https://www.mhc.tn.gov.in/judis CRL OP No. 15401 of 2026 __________ Page3 of 6 before the learned Judicial Magistrate No.I, Ponneri, on 29.06.2026 and that the same is yet to be taken on file. 4. In response, the party-in-person submitted that the charge sheet was filed only after the present quash petition has been filed and therefore, requested this Court to consider the matter on merits. According to her, the complaint was lodged by her mother-in-law and the allegations contained therein are wholly false. It was further contended that, owing to the influence wielded by the complainant, the police were persuaded to register the FIR. The party-in-person also submitted that, although the defacto complainant alleged that she was attacked, there is absolutely no materials available to substantiate such allegations. 5. Refuting the said submissions, the learned Government Advocate (Criminal Side) submitted that, during the course of investigation, the Accident Register copy from the Government Hospital, Ponneri, was collected and the Doctor who treated the defacto complainant was also examined. 6. The party-in-person further contended that the FIR itself was registered nearly six and a half months after the alleged date of occurrence. However, all these contentions involve disputed questions of fact which can be effectively adjudicated only during the course of trial, on appreciation of evidence and by https://www.mhc.tn.gov.in/judis CRL OP No. 15401 of 2026 __________ Page4 of 6 cross-examination of the prosecution witnesses. 7. In view of the above, this Court is of the considered opinion that no grounds are made out for quashing the proceedings. The petitioner is at liberty to obtain a copy of the final report and work out her remedies in the manner known to law, if so advised. It is also open to the petitioner to raise all the above grounds before the trial Court and contest the case on merits. 8. Accordingly, the Criminal Original Petition stands disposed of. The Registry, therefore can return the originals to the party-in-person.
