ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the second respondent herein to survey measure, demarcate and subdivide the petitioner’s property comprised in Survey Nos.77/5B, 77/5A, 76/1, 77/6 and 76/3 measuring an extent of 77.82 cents, situated in Vaduvur Thenpathi village,Needamangalam Taluk, District of the Sub Registrar Mannarkudi,
2. The petitioner submits that in order to ascertain the correct boundaries of the subject property, he submitted an online application dated 10.04.2026 to the respondents requesting a survey. However, the said application has not been considered till date. Aggrieved by the inaction on the part of the respondents, the petitioner has been constrained to file the present Writ Petition. __________ Page2 of 5 https://www.mhc.tn.gov.in/judis

3. Heard the learned counsel for the petitioner and Mr. M. Guruprasad, learned Government Advocate for the respondents.
4. Considering the facts and circumstances of the case and the
submissions made on either side, this Court directs the respondents 2 and 3 to consider the petitioner's online application dated 10.04.2026 and conduct survey of the subject property and fix boundary stones within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. 5. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
