Pachaiyappan Government Counsel ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 1st respondent to conduct survey of the petitioners land situated at comprised in SF Nos. 205/1A1A , 206/2G2A and 206/2G2C, Amman Koil Area, Rettipatti Revenue Village, Uthangarai Taluk, Krishnagiri District and to fix the boundaries in accordance with revenue records on considering the petitioner’s online application dated 05.03.2026. 2. The petitioner submits that in order to identify, measure and demarcate the boundaries of the subject property, she submitted an online application dated 05.03.2026 to the 1st respondent requesting a survey. However, the said application has not been considered till date. Aggrieved by the inaction on the part of the first respondent, the petitioner has been constrained to file the present Writ Petition. __________ Page2 of 5 https://www.mhc.tn.gov.in/judis WP No. 24565 of 2026 3. Heard the learned counsel for the petitioner and Mr. B. Pachaiyappan, learned Government Advocate for the respondents. 4. Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the respondents 1 and 2 to consider the petitioner's online application dated 05.03.2026 and conduct survey of the subject property and fix boundary stones within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party.
