Rakib CRM (NDPS) 2020 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sagarpara Police Station case no. 475 of 2026 dated 14.06.2026 under Sections 21(C)/29 of the NDPS Act. And In the matter of : Shiparul Sk @ Siparul Sk ……Petitioner. Mr. Arnab Chatterjee Mr. Avik Ghosh Ms. Ankusha Ghosh ......for the Petitioner. Mr. Ayan Basu Mr. Gautam Banerjee ……for the State. Learned advocate appearing for the petitioner submits that there has been no recovery from the present petitioner, although, 360 bottles of eskuf cough syrup were recovered in the present case from a different accused person. Learned advocate appearing for the State opposes the prayer for bail. On a specific query form this Court, learned advocate appearing for the State submits that so far as the memo of evidence is concerned, there is no reflection whether there is any criminal antecedents of the petitioner and the Case Diary do not reflect that there are call detail record or the money trail is available so far as the present petitioner is concerned with other accused persons. However, the investigation of the case is in progress, in case there are no further changes relating to recovery or CDR or money 2 trail so far as the petitioner’s complicity in the present case is concerned, the learned trial Court in such circumstances would after the charge-sheet is submitted release the petitioner on bail on such terms and conditions as he deems fit and proper. In view of the aforesaid, CRM (M) 2020 of 2026 is disposed of. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
