ORDER This petition is filed seeking to modify the order dated 15.06.2026 passed in Crl.R.C.No.927 of 2026 instead of ready to pay Rs.1,00,000/- remaining https://www.mhc.tn.gov.in/judis
CRL MP No. 10945 of 2026 __________ Page2 of 5 payment to the respondent, it should be read as remaining payment Rs.60,000/- to the respondent.
2. Learned counsel for the petitioner submitted that in paragraph 2 of the
order passed by this Court on 15.06.2026, it has been wrongly mentioned that the petitioner is ready to pay the remaining Rs.1 lakhs to the respondent, whereas, only an amount of Rs.60,000/- is the actual remaining balance of the cheque amount to be paid to the respondent. He further submitted that the petitioner has already deposited Rs.1,00,000/- before the trial court, in compliance of the order passed by this court in this Revision and apart from that he has already deposited Rs.40,000/- before the trial court on 23.06.2022, but, the said fact was not brought before this court while passing the order. In this regard, he has also produced deposit receipt dated 23.06.2022 showing that Rs.40,000/- has been deposited before the trial court. Thus, the total amount of Rs.1,40,000/- has been paid to the respondent and only the remaining balance of Rs.60,000/- has to be paid to the respondent. Thus he prayed to modify paragraph No.2 of the order dated 15.06.2026 and pass suitable orders.
3. Counsel for the respondent submitted that out of Rs.2 lakhs, his client has received Rs.1,40,000/- and the balance amount of Rs.60,000/- only is to be paid. He has no objection to the proposal made by the learned counsel for the petitioner. https://www.mhc.tn.gov.in/judis

4. Heard the submissions of the learned counsel for the petitioner and the
learned counsel appearing for the respondent.
5. The deposit receipt dated 23.06.2022 is taken on record.
6. Accordingly para 2 is modified and corrected and shall be read as under in future: ‘Learned counsel for the petitioner further submitted that his client is ready to pay the remaining Rs.60,000/- to the respondent and shall arrange the fund. On the next date of hearing. he will bring the Demand Draft in favour of the respondent. He has also submitted that this court while exercising its power, under section 147 of the Negotiable Instrument Act by compounding the offence and dispose of this petition finally.
7. This petition is accordingly allowed.
