Contents of Joint Memo reads as under: "The petitioner and respondent submit as follows: 1. That the petitioner and respondent are intending to compound the case and respondent is not intending to proceed further with the case against the accused. - 3 - HC-KAR NC: 2026:KHC:21565 CRL.RP No. 1446 of 2022 2. The petitioner is agreed to pay entire amount of Rs.1,47,737/- and the respondent agreed to the same. 3. The petitioner has already deposited 70% o the amount before the Trial Court and the respondent is permitted to withdraw the same. 4. The petitioner submits that, the remaining 30% o the amount is being paid today by way of DD bearing No.007997, dated 18.04.2026 in favour of M/s. AKSHARA DRUG HOUSE PVT LTD in amount of Rs.Forty Four Thousand Tree Hundred Eighteen only. 5. Wherefore the petitioner pray that this Hon'ble Court be pleased to record thee compromise and set aside the judgment and conviction of the trial court in the interest o justice and equity." 2. A Demand draft bearing No.007997, drawn on Axis Bank, in a sum of Rs.44,318/- tendered by the petitioner to the respondent. Same is acknowledged in the order sheet. 3. Amount in deposit is ordered to be withdrawn by the complainant if not already withdrawn, under due identification. 5. It is made clear that if there is any default in the payment of compensation amount as agreed in the memo, then the petitioner shall undergo imprisonment as ordered by the Trial Magistrate confirmed by the First Appellate Court.
