And In the matter of : Mithun Barman ……Petitioner. Mr. M. Nazar Chowdhury Ms. Farheen Rais Mr. Yousuf Hassan ……for the Petitioner. Mr. Anamitra Banerjee Mr. Soumya Raha ….for the State. Learned advocate appearing for the petitioner submits petitioner was arrested on 22.09.2025 and since then he is in custody. Only charge has been framed till date but witness action has not commenced. State has opposed the prayer for bail, drawn the attention of the Court to the statement of the victim under Section 183 of the BNSS and the Medico Legal Examination Report. Having considered the tender age of the victim which is of 15 years and the petitioner being of 24 years age, at this 2 stage, without the cross-examination of the victim being over, I am not inclined to release the petitioner on bail. Accordingly, CRM (M) 2326 of 2026 is dismissed. Learned Trial Court is directed to ensure that the evidence of the victim is completed by 15th January, 2027. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
