06.10.2026 Serial nos. 49 [AN] Ct. No. - 39 CRR/3875/2026 (CRAN 1 of 2026) In re : An Application under Section 482 of the Code of Criminal Procedure, 1973 -And- In the matter of : Kaustav Jagat Roy & ors. … … Petitioners. Mr. Abhra Jena Mr. Bikram Mitra Ms. Priyanka Jaiswal … for the petitioners Mr. Younus Sultan Mr. S. Khara … for O.P. No. 2 Mr. Brajesh Jha Mr. Debojyoti Adhikary Mr. Mukesh Kr. Gupta … for the State 1. The petitioners have approached this Court for setting aside or quashing of the criminal proceedings arising out of Technocity Police Station Case No. 0098 of 2026 dated 25.06.2026 under Sections 85/117(2)/316(2)/3(5) of the BNSS, 2023, corresponding to G.R. Case No. 2259 of 2026 pending before the learned Chief Judicial Magistrate, Barasat, North 24 Parganas. 2. It is submitted that during the pendency of the instant case, a joint compromise application, being CRAN 1 of 2026, has been filed by the parties seeking appropriate order for quashing of the proceedings on account of having arrived at a 2 settlement and compromise between the parties with intervention of the friends and well-wishers, out of court. 3. It is further submitted that the husband and the wife are now residing together peacefully and the FIR was registered against the accused on the basis of misunderstanding. The terms and conditions mentioned in the joint petition also reflect the same. 4. Learned advocate representing the State concedes that the joint compromise application has also been submitted to the I.O. as the charge sheet has not been submitted yet. 5. Having heard the learned advocates for the respective parties and on perusing the materials on record, it appears that the dispute between the parties is purely private and basically personal in nature and in such case, there is no impediment to allow the prayer for quashing of the proceedings in exercise of power conferred under Section 482 of the Cr.P.C. 6. Accordingly, the criminal proceedings arising out of Technocity Police Station Case No. 0098 of 2026 dated 25.06.2026 under Sections 85/117(2)/316(2)/3(5) of the BNSS, 2023 corresponding to G.R. Case No. 2259 of 2026 pending before the learned Chief Judicial Magistrate, Barasat, North 24 Parganas are quashed. 7. With the above observations and directions, CRR 3875 of 2026 stands disposed of. Consequently, CRAN 1 of 2026 is also disposed of. 8. Interim order, if any, stands vacated. 3 9. Let a copy of this order be communicated to the learned trial court for necessary compliance. 10. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. 11. The concerned Department is directed to supply urgent certified Photostat copy of this order to the parties, if applied for, upon compliance of all necessary formalities. (Ajay Kumar Gupta, J.)
