JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Sri Pawan Kumar, learned counsel is directed to accept notice for the respondents. 2. The petitioner is before this Court seeking the following reliefs: "i. issue a writ of certiorari or such other appropriate writ or orders, or direction, quashing the notice bearing No.Sa.Ka.Ni,Aa(K.Gou.Na) G.L/P.R./01/2025-26 i e Annexure-A dated 30.12.2025 issued by the 2nd Respondent is illegal, arbitrary, opposed to law and without any jurisdiction. ii. restraining the Respondents, from taking any coercive action, including demolition, sealing or interference with the Petitioner's peaceful possession and use of the premises, pursuant to the impugned notice. iii. Grant such other and further reliefs as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice and equity." 3. The contention of learned counsel for petitioner is that by way of impugned notice at Annexure-A, - 3 - HC-KAR NC: 2026:KHC:4482 WP No. 2169 of 2026 coercive steps may be likely to be taken by the respondents without considering the objections to be submitted by the petitioner inasmuch as a positive direction issued under said notice for the petitioner to comply. 4. A perusal of Annexure-A indicates that it is an inspection report where certain observations have been made. Even when such observations are made before any action is taken by the respondents- authorities, it is required for the respondents- authorities to consider the say of the petitioner before such orders are passed. 5. In that view of the matter, I pass the following: ORDER i) The writ petition stands disposed by permitting the petitioner to reply to the notice at Annexure-A within a period of 15 days from today. - 4 - HC-KAR NC: 2026:KHC:4482 WP No. 2169 of 2026 ii) If such reply is submitted within a period of 15 days, the respondents are directed to consider the said reply and pass necessary orders in accordance with law. iii) In the event of no reply being received within 15 days from today i.e. on or before 11.02.2026, the respondents are free to proceed with any action as permitted under Annexure-A. iv) This Court has not expressed any opinion on the entitlement or otherwise of the petitioner, the same would have to be dealt with by respondents in accordance with law. v) Until orders are passed by the respondents, needless to say, no coercive steps can be taken against the petitioner.
