JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Petitioners are before this Court seeking for the following reliefs: “a) To consider order of the 4th respondent dated 22.4.2019 to effect the inheritance katha jointly in favour of the petitioners in respect of the property bearing Khaneshumari No.52, Gantiganahalli Gram Panchayathi Katha No.62/52, situated at Gantiganahalli Village, Yelahanka Hobli, Bangalore North Taluk, measuring east to west 33.52 meters and north to south 28.95 meters in all totally measuring 940.40 sq meters (East to West 110 feet and North to South 95 feet totally measuring 10450 sq feet) as per ANNEXURE-K. b) Direct the respondents No.2 and 3 PDO and Secretary of Gantiganahalli Gram Panchayathi by considering the several requests made by the petitioners for transfer of inheritance katha in favour of the petitioners in respect of the said property as per ANNEXURE-B. c) To grant such other relief as this Hon'ble Court deems fit to grant in the facts and circumstances, including the costs of the writ petition, in the interest of justice and equity.” - 4 - HC-KAR NC: 2026:KHC:3686 WP No. 11331 of 2020 2. The grievance of the petitioners is that the petitioners' application for effecting inheritance Khata in favour of the petitioners in respect of property bearing Khaneshumari No. 52, Gantiganahalli Grama Panchayathi Khata No.62/52 situated at Gantiganahalli Village, Yelahanka Hobli, Bangalore North Taluk, has not been considered and necessary action taken by the respondent despite representation having been submitted at Annexure-B to the petition dated 14.05.2015. There are several correspondences which have taken place between the Executive Officer and the Panchayath Development Officer. No action has been taken. The petitioners once again submitted representation on 27.12.2019 under Annexure-M1, which has also not been considered and it is in that background the petitioners are before this court seeking the aforesaid reliefs. - 5 - HC-KAR NC: 2026:KHC:3686 WP No. 11331 of 2020 3. Whenever any application is filed for effecting inheritance Khata or otherwise, it is required for the authorities to consider the same and pass necessary orders within the time frame prescribed under the Karnataka Sakala Services Act, 2011. The first application in the present matter has been filed in the year 2015 and subsequent representation on 22.04.2019 and for a period of nearly six years, no action has been taken by the respondents. If at all there is a reason for rejection of the said application, respondents ought to have passed an order of rejection by giving suitable reasons. Neither an order of acceptance nor rejection has been passed by the respondents. Hence, I pass the following: ORDER i. Petition is allowed. ii. Respondent No.4 is directed to consider the application of the petitioners dated 22.04.2019 - 6 - HC-KAR NC: 2026:KHC:3686 WP No. 11331 of 2020 in terms of the correspondence which has been exchanged between the concerned respondent and pass necessary orders within 30 days from the date of receipt of copy of this order.
