JUSTICE DEVASHIS BARUAH ORDER 22.04.2026 Heard Mr. S Hoque, the learned counsel appearing on behalf of the petitioner and Mr. B Gogoi, the learned Addl. AG, Assam, who appears on behalf of the PWD, Assam.
2. The petitioner herein has assailed the cancellation notice dated 30.12.2025 whereby the NIT bearing DNIT No.CE/DEV/TB/116/2025-26/59 dated 14.11.2025 issued for the work pertaining to improvement and upgradation of road from Dwarbond Bazar at Silchar-Hailakandi Road to Belaipur via Lowerbond F.V. (Ch.0.00 km to Ch.10.0km) under Asom Mala 3.0 for the year 2025-2026 was cancelled.
3. The grounds on which the instant writ petition has been filed is that the petitioner had participated in the said NIT which was issued on 14.11.2025. It is an admitted fact that prior to opening of the technical bids in respect to the NIT dated 14.11.2025, the said tender was cancelled.
4. Under such circumstances, it is the opinion of this Court that no right accrues upon the petitioner on the basis of mere participation in the said NIT.
5. Consequently, this Court does not find any merit in the instant writ petition for which the writ petition stands dismissed. JUDGE Comparing Assistant
