And In the matter of: Md. Shejaan …. Petitioner Mr. Abhishek Chakraborty …for the petitioner Ms. Anasua Sinha, Ld. APP Ms. Snigdha Saha ..for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. He is in no way connected with the alleged offences. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. She relies on the report and the case diary and submits that the victim was checking his CIBIL score online. He received a call and was finally duped of a sum of money. The money went to the account of the principal accused. The principal accused claimed that he had given his ATM card to the present petitioner and passport book and cheque book to another co- accused that other co-accused has also been arrested. The two arrested accused are not the one who took out the money from the ATM counter as per the CCTV footages. Therefore, the petitioner is the one who took out the money from the ATM counter and after he is arrested, he can be identified. 2 Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected. The presence of the I.O. is noted and is dispensed with. (Jay Sengupta, J.)
