The case of the prosecution is that the petitioner, along with others have cheated 37 victims to the tune of Rs.75,00,000/- under the guise of providing employment in foreign countries, which led to the registration of an FIR. Hence, the present petition has been filed by the petitioner for seeking bail. 3. The learned counsel for the petitioner submitted that this is the second bail application filed by the petitioner and that the earlier bail application was dismissed on the ground that the investigation was pending. He further submitted that the petitioner was arrested and remanded to judicial custody since 18.05.2026. According to the prosecution, a sum of Rs.75 lakhs was collected from the victims, whereas only a sum of Rs.38,00,000/- was transacted through the petitioner’s account. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner. 4. The learned Government Advocate (Crl.Side) strongly opposed the bail application and submitted that the petitioner has no previous criminal antecedents against him. Hence, he opposed the grant of bail to the Petitioner. 5. At this juncture, the learned counsel for the petitioner submitted that, in order to show his bonafide, he is willing to deposit a sum of Rs.2,00,000/- to https://www.mhc.tn.gov.in/judis CRL OP No. 16835 of 2026 __________ Page3 of 6 the credit of the Crime Number. 6. I have given my anxious consideration to either side submissions and perused the materials available on record. 7. From the submission made by the learned Government Advocate (Crl.Side), it is a clear case of cheating of 37 victims under the guise of providing employment in foreign countries and collected a sum of Rs.75,00,000/-. However, only a sum of Rs.38,00,000/- was transacted through the petitioner’s bank account. Considering the fact that the petitioner has been in incarceration since 18.05.2026, the petitioner has no previous criminal antecedents, and that his further custodial interrogation is not required for the purpose of investigation, this Court is inclined to grant bail to the petitioner, subject to certain conditions. 8. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Virdhachalam, and on further conditions that: [i] The petitioner is ordered to be enlarged on bail on condition that the petitioner shall deposit a sum of https://www.mhc.tn.gov.in/judis CRL OP No. 16835 of 2026 __________ Page4 of 6 Rs.2,00,000/- (Rupees Two Lakhs only) to the credit of Crime No.11 of 2026 on the file of the Judicial Magistrate No.I, Virdhachalam, within a period of four weeks from the date of receipt of a copy of this order. (ii) On such deposit being made, the Trial Court shall redeposit the said amount in a Fixed Deposit Account, in any one of the Nationalised Banks, renewable thereafter periodically. The disbursal of this amount shall be decided at the culmination of the Criminal Original Petition. (iii) the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [iv] the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders; [v] the petitioner shall not abscond either during investigation or trial; [vi] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [vii] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble https://www.mhc.tn.gov.in/judis CRL OP No. 16835 of 2026 __________ Page5 of 6 Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [viii] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 08-07-2026 DRL Note: 1.
