Heard Mr. N. Ahmed, learned counsel appearing for the petitioner. Also heard Mr. K.K. Parasar learned Addl. P.P for the State of Assam.
2. This bail application has been preferred under Section 483 of the BNSS, 2023, praying for the grant of regular bail to the accused/petitioner, who has been
Page No.# 2/2 arrested on 17.03.2026 in connection with Basistha P.S. Case No.78/2026, under Section 305(a)/ 334 (1) of BNS, 2023.
3. By the order dated 22.04.2026, it was recorded that the learned counsel for the petitioner had been informed by the petitioner that the I.O had informed the petitioner that the case diary was on the way and would reach the Court after some time.
4. Today, the learned Addl. P.P. has submitted that there was no such communication from the I.O. to any person involved in the matter, and naturally so, since the charge sheet had already been submitted on 31.03.2026, and the question of submitting a case diary on 22.4.2026 would not arise.
5. Since the matter has now been clarified and the petitioner was on interim protection by this Court through the order dated 23.03.2026, this Court is of the view that with the submission of the charge-sheet, the interim bail granted to the petitioner can be made absolute.
6. Accordingly, the interim protection granted on 23.03.2026 is made absolute, and the bail application is disposed of. JUDGE Comparing Assistant
