CRL.M.A. 14022/2026 By way of the present application filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks extension of parole for a period of 60 days. Parole was initially granted to the petitioner vidé order dated 05.02.2026 passed by the concerned prison authorities, and was thereafter extended by this court from time- to-time, which extension runs-out today. The Petitioner was released from custody on 09.02.2026 and has been out on parole ever-since. 2. The petitioner had sought parole on the ground that his wife needs a kidney transplant; and the petitioner is the prospective kidney donor. This is a digitally signed order. Ms. Vrinda Bhandari, learned counsel appearing for the petitioner has explained to the court the run of events in relation to the kidney transplant surgery of the petitioner’s wife. Learned counsel submits, that in addition to the tests that the wife has undergone for the surgery, the petitioner himself had to undergo several tests and obtain a no- objection certificate from the Department of Anesthesia & Intensive Care of VMMC & Safdarjung Hospital as a prospective renal donor for his wife; and he has now been referred to the Nephrology Department of the said hospital. 4. Ms. Bhandari submits, that the attending doctors have now granted the requisite no-objection certificate to the petitioner, as evidenced by certain prescriptions appended to the present application. Learned counsel submits, that the no-objection certificate is based on a whole raft of tests that the petitioner had to undergo; and the tests reports are now to be furnished to the doctors who will be conducting the surgery. 5. Upon being queried regarding the date of surgery, Ms. Bhandari submits, that once the tests reports are shown to the doctors, they would indicate a date of surgery and the further protocols be followed by the petitioner and his wife. 6. Ms. Bhandari states, that the tests the petitioner has undergone would be wasted if there is a time-gap between the tests and the surgery that has to be scheduled. 7. Issue notice. 8. After a brief hearing, the petitioner is directed to furnish the requisite tests report to the attending doctors and obtain clear timelines for the steps to be taken for the kidney transplant operation, in particular, the period of post-operative care that would be required by the petitioner’s wife as well as by the petitioner. 10. Dr. Manoj Kulpati, the transplant coordinator at Safdarjung Hospital, and Dr. Pallavi Joshi are requested to indicate the aforesaid timelines clearly. 11. Further orders in the present application shall be passed based on the doctors’ report. 12. In the meantime, the petitioner’s parole shall stand extended till the next date of hearing before this court. 13. Re-notify on 25th May 2026. 14. The Medical Superintendent, VMMC & Safdarjung Hospital is requested to facilitate the process. 15. The Registry is directed to forward a copy of this order to the Medical Superintendent, Safdarjung Hospital and to the concerned Jail Superintendent forthwith. 16.
