CRL OP No. 17054 of 2026 __________ Page2 of 5 For Petitioner(s): Mr.N.U.Pressanna For Respondent(s): Mr.R.Rajasekaran Counsel for Government of Tamil Nadu (Crl.side) For R1 ORDER The prayer of the criminal original petition is filed to quash the FIR in crime No.90 of 2025. 2.Upon considering the gist of allegations in the FIR, the case is that the first accused by name Muralikrishnan repeatedly lured many persons and call them to the headquarters of the DMK party and other places and have been taking money from different persons for getting different jobs and had neither got them the job nor paid the money back. Therefore, the complaint is lodged. In the complaint, the allegation is also made that his wife the 3rd accused and his father the 2nd accused are also aiding him in the crime. 3.The learned counsel for the petitioners would submit that there is absolutely no connection for the accused Nos.2 and 3 in the offence. Even as per the averments made, it can be seen that all the amounts were handed over by the defacto complainant only to the first accused. He is already absconding from the house. While so, even prior to the registration of the FIR on 18.02.2025 itself, the defacto complainant trespassed into the house of the accused No.2 and https://www.mhc.tn.gov.in/judis
CRL OP No. 17054 of 2026 __________ Page3 of 5 forced him to affix his left thumb impression and pressurised him for making the payments. At the relevant point of time itself, the petitioner has lodged a complaint on 18.02.2025 and a receipt in CSR No.133 of 2025 was also given.
Without completing the enquiry in that regard, the FIR is simply registered as against the petitioners also. There is no material at all as against the petitioners. 4.The learned Counsel for Government of Tamil Nadu for the first respondent would submit that when the allegation is made in the FIR that the accused Nos.2 and 3 also aided and helped the prime accused, they were also included in the FIR. 5.I considered the rival submissions made on behalf of the petitioners. The crux of the argument is that while the allegations are made as against the accused No.1, who is the son of the accused No.2 and husband of the accused No.3, only by way of an embellishment so as to include the family members, to put pressure, their names are added in the FIR. Even if it may be a case, the same should only turn out in the investigation. Once an allegation is made, the law is now settled that the investigating officer at that stage cannot go into the truth or otherwise of such allegations that is made in the complaint and only in the investigation, whether it is an embellishment or whether the petitioner actually helped and aided the first accused in the whole episode will turn out. CRL OP No. 17054 of 2026 __________ Page4 of 5 information to the investigating officer, if they choose to and keeping their liberty open to challenge the final report, if they are prosecuted without any materials on record, the prayer made to interdict with the FIR at this nascent stage of the investigation cannot be acceded to and accordingly, the criminal original petition stands disposed of.
