This is first Anticipatory bail application filed by the applicant under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.120/2026 registered at Police Station – Tikrapara, District - Raipur (C.G.) for the offence punishable under Sections 318(4) and 3(5) of BNS, 2023. 2. Case of the prosecution, in brief, is that complainant HARISH DHRUV lodged written report in Police Station - Tikrapara Raipur CG that he is resident of Moti Nagar Yash Vihar colony Raipur one VISHWNATH GUPTA resident of Jashpur gave him assurance that he VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.04.13 18:05:37 +0530 2 will give him job as a driver, office assistant post /job to his wife and two others namely Vashini and Yamini Dhruv, data entry office job to his relative Manoj Dhruv and peon post to Damandas Manikpuri and for this took about 5,50,000/- rupees and on different occasion further took about 6 lakh rupees complainant also alleges that he took about 20 lakh from Swapnil Dubey. Also alleged Chandrama Gupta and applicant were involved in this. Allegation upon present applicant - Dipesh Navarang is that he verified them in Mantralaya. complainant has alleged that accused persons induced him and others to pay money for securing jobs and an amount of approximately 31,50,000/- is alleged to have been collected. That investigation is going on and applicant is apprehending arrest. and thereby committed offences under Sections 318 (4) and 3(5), of B.N.S. 3. Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that there is no direct and cogent material to establish his involvement in the alleged offence, therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, learned State counsel, opposes the bail application and submits that applicant has one criminal antecedent bearing crime No.54/2025 registered at Police Station – Civil Lines, Raipur for offence under Sections 420, 467, 468, 471/34, which is pending for it’s conclusion. He also submits that under the pretext of securing employment for the complainant, the accused by luring the complainant and others with false promises of jobs collected a total sum of approximately 31,50,000/-; therefore, he is not entitled to ₹ anticipatory bail. 3 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, submissions made by learned counsel for the parties, nature of offence and allegation levelled against the present applicant and applicant has one criminal antecedent, further considering the fact that total amount of approximately 31,50,000 was collected by the ₹ applicant under the pretext of false promises of jobs, this Court is of the opinion that it is not a fit case to enlarge the applicant on anticipatory bail. 7. Accordingly, this bail application of applicant – Dipesh Navrang, involved in Crime No.120/2026 registered at Police Station – Tikrapara, District - Raipur (C.G.) for the offence punishable under Sections 318(4) and 3(5) of BNS, 2023, is rejected at this stage.
