Heard the learned counsel for the respective sides.
This appeal is directed against the order dated 07.01.2026 passed by the learned Additional Sessions Judge-XI, Dhanbad in B.P. No. 1005 of 2025 arising out of Dhanbad G.R.P.S. Case No. 104/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that the Police had recovered two minor children from Vasco Da Gama Express and the appellant as well as another co- accused were apprehended. It has been alleged that they were involved in human trafficking.
Submission has been advanced by the learned counsel for the appellant that the appellant was merely a passenger in Vasco Da Gama Express when he was implicated. Learned counsel further submits that one of the co-accused Harilal Ram has been granted bail by this Court in Criminal Appeal (DB) No. 163 of 2026. Learned counsel adds that the appellant is in custody since 15.10.2025.
Learned Spl.PP has opposed the prayer for bail of the appellant.
Regard being had to the fact that the case of the appellant seems to be similarly situated to that of the co-accused who has been granted bail as noted above, we while setting aside the order dated 07.01.2026 passed by the learned Additional Sessions Judge-XI, Dhanbad in B.P. No. 1005 of 2025 arising out of Dhanbad G.R.P.S. Case No. 104/2025, direct that the appellants be released on bail on furnishing bail bond of Rs. 10,000/-
(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Dhanbad in connection with Dhanbad G.R.P.S. Case No. 104/2025.
This appeal is allowed.
