The learned counsel for the petitioner submitted that the petitioner is one of the victims in the criminal case allegedly committed by the third respondent. According to the petitioner, the third respondent is a habitual offender and is facing several criminal cases. Therefore, the petitioner submitted the aforesaid representation to respondents 1 and 2 requesting them to detain the third respondent under Act 14. 3. The learned Government Advocate (Crl. Side) appearing for respondents 1 and 2 reiterated the prosecution case and submitted that the petitioner is not the competent authority to suggest, direct, or require https://www.mhc.tn.gov.in/judis WP Crl. No. 1559 of 2026 __________ Page3 of 5 respondents 1 and 2 to detain the third respondent under Act 14. He further submitted that it is for the competent authority to decide whether preventive detention is warranted under the provisions of Act 14, based on the facts and materials available. 4. Heard the learned counsel appearing on either side and perused the materials available on record. 5. It is for the competent authority to consider whether a person is liable to be detained under the provisions of Act 14, based on the materials available and the facts and circumstances of the case, in accordance with law. The petitioner cannot seek a writ directing the authorities to detain a particular individual under the preventive detention law. Therefore, no direction can be issued to respondents 1 and 2 to consider the petitioner's representation in the manner sought. 6. Accordingly, this Writ Petition is dismissed.
