Action has been initiated against the petitioner by the respondent - Bruhath Bengaluru Mahanagara Palike, now the Greater Bengaluru Authority (GBA) for putting up construction in violation of the building bye-laws and the sanctioned plan. Aggrieved by the same, the present writ petition is filed with the following prayers:- A. Issue Writ of Mandamus commanding the Respondents to initiate appropriate steps as may be necessary, pursuant to the Order of confirmation bearing No.AEE/D/CO/02/2023-24 dated 25.05.2023 issued by the 2nd Respondent, produced at ANNEXURE B, either to close the further proceedings or to regularise the violations, considering the Petitioner's representation dated 12.07.2023 vide ANNEXURE-A. b. Pass any other order or grant any other relief, this Hon'ble Court deems fit in the facts and circumstances of - 3 - HC-KAR NC: 2026:KHC:20721 WP No. 15947 of 2023 the case in the interest of justice, equity and good conscience." 2. On 12.01.2026, this Court had passed the following order:- "1. Respondent No.2 along with the Assistant Director of Town Planning of Domlur Sub-Division are directed to cause an inspection of the property of the petitioner bearing No.19 Vellriamma Temple Street, Vanarpet, Ward No.115, Bengaluru-560047, to ascertain as to whether the construction is in accordance with the plan sanction /building bye-laws. If not, what are the violations / deviations in terms of all aspects covered under the building bye-laws including setbacks, FAR, open spaces, etc. 2. Since the order is passed at the request of the counsel for the petitioner, the said inspection to be carried out commencing from 10.30 a.m., on 17.01.2026 and the report to be submitted by 28.01.2026. 3. Re-list on 28.01.2026. 4. Interim order granted earlier is extended till the next date of hearing." 3. Pursuant to the said order, GBA has filed a report dated 15.04.2026 stating that there is construction which is put up in violation of the building bye-laws and the sanctioned plan by - 4 - HC-KAR NC: 2026:KHC:20721 WP No. 15947 of 2023 the petitioner. The spot inspection report shows the extent of the deviations made by the petitioner. 4.
