JUSTICE S.R.KRISHNA KUMAR ORAL ORDER This petition by the plaintiff in Com.O.S.No.134/2024 is directed against the impugned order dated 07.01.2025, whereby the applications in I.A.Nos.6 and 7 filed by the respondents – defendants seeking recalling of the order dated 25.09.2024 and to permit the respondents – defendants to contest the suit of the plaintiff were allowed by the Commercial court. 2. After arguing the matter for sometime, learned counsel for the petitioner submits on instructions that the petitioner has no - 3 - HC-KAR NC: 2026:KHC:2707 WP No. 2768 of 2025 objection for the present petition to be disposed of without interfering with the impugned order by setting aside the findings and observations and imposition of cost of Rs.3,000/- on the petitioner - plaintiff by the Commercial court while allowing the applications. The said submission is placed on record. 3. Accordingly, petition stands disposed of as withdrawn without interfering with the impugned order. However the findings, observations etc., made by the Commercial Court as well as imposition of cost on the petitioner are hereby set aside and expunged.
