CRL.O.P.No.11231 of 2026 __________ Page2 of 4 PRAYER: Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 to call for the entire records quash the final report riled in CC.No.659 of 2025 on the file of the Judicial Magistrate, Kangeyam as against the petitioners and pass such other further or other orders. For Petitioners: Mr.V.Regunathan For Respondents: Mr.Mohamed Riyaz, Government Advocate (Criminal side) For R1 *** O R D E R This Criminal Original Petition is filed to quash the final report and proceedings in C.C.No.659 of 2025. Even though the petition was filed on merits, today, when the matter came up for hearing, the parties were present and a Joint Compromise Memo is filled. The learned counsel seeks to quash the case on compromise. 2. I also examined the de facto complainant. He would submit that the case can be quashed on compromise. The accused persons are also present. 3. The Joint Compromise Memo is filled, which is duly signed by the parties. Upon considering the allegations, it is stated that when the de facto complainant’s mother was standing at a particular place, a bike was driven in a rash and negligent manner and when the de facto complainant's mother confronted the same, the accused 1 to 4, who thereafter came to the spot, https://www.mhc.tn.gov.in/judis

Considering the overall facts and circumstances of the case, I am of the view that the facts of this case would permit this Court to exercise its extraordinary jurisdiction under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, and the case comes within the four corners of the law laid down by the Hon’ble Supreme Court of India in the case of Gian Singh vs. State of Punjab1 , and is liable to be quashed. 5. Accordingly, the Criminal Original Petition in Crl.O.P.No.11231 of 2026 stands allowed. The final report and all for the proceedings in C.C.No.659 of 2025 shall stand quashed. Consequently, connected miscellaneous petitions are closed. 03-07-2026
