By way of this bail application, the petitioner prays for grant of regular bail in connection with Satgawan Police Station Case No.117 of 2025, registered for offences alleged under Sections 126(2), 115(2), 117(2), 109(1), 333, 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of the Judicial Magistrate 1st Class, Koderma.

First Information Report being Satgawan Police Station Case No.117 of 2025 was registered on the basis of written report filed by the informant. It has been alleged that the petitioner entered the house of the informant all of a sudden on 30.10.2025 at about 08.00 p.m. armed with sharp weapon. When the informant asked him as to why he has come to assault her, the petitioner replied to ask it from Khusboo Devi and assaulted behind informant’s head and on her back by a sharp cutting weapon. It has been alleged that the petitioner had covered his face with black cloth, but while assaulting the cloth slipped and informant identified the petitioner. It has also been alleged that on 28.10.2025 at about 11.00 p.m. a call was made on her phone through mobile number 7320898538 threatening her that she would be killed in four days.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that the petitioner, who is a resident of Giridih, was working as mason in the house of Khusboo Devi and due to enmity between Khusboo Devi and the informant, petitioner has been implicated in this case. He further contended that the allegations in the First Information Report do not attract the alleged Sections of the Bharatiya Nyaya Sanhita.

Learned A.P.P. appearing for the State as also the counsel appearing for the informant vehemently oppose the prayer for bail of the

petitioner.

From the petition and from the arguments of the parties, I find that there is direct allegation against the petitioner of assaulting the informant behind her head and on her back with a sharp weapon.

Considering the nature of allegation, I am not inclined to grant bail to the petitioner. Prayer for bail of the petitioner in connection with Satgawan Police Station Case No.117 of 2025, pending in the Court of the Judicial Magistrate 1st Class, Koderma, is hereby rejected.

This bail application is, accordingly, dismissed.
