Nos.276/3 and 276/4 situated at Mettupalayam North Village, Veppanthattai Taluk, Perambalur District, with the aid of the 3rd respondent, within a time frame to be fixed by this Court, and consequently mutate the revenue records in the name of the petitioner. 2. The petitioner contends that the subject properties in S.F.Nos. 276/3 and 276/4 were originally assigned in 1975 and subsequently sold under a registered Sale Deed in 1992. The petitioner's vendors, Karuppaiya and Saroja, obtained a decree declaring their title and granting mandatory injunction in O.S.No.359 of 1996, which was confirmed in appeal. The petitioner purchased the properties through a registered Sale Deed dated 29.11.2012, and patta was duly transferred in his favour. Although Annapoornam sought cancellation of the petitioner's patta, the District Revenue Officer's order was set aside by this __________ Page2 of 6 https://www.mhc.tn.gov.in/judis WP No. 24116 of 2026 Court in W.P.No.33257 of 2016, restoring the petitioner's patta. Subsequently, the pending Second Appeal (S.A.No.1197 of 2009) was also dismissed, thereby confirming the title of the petitioner's vendors and, consequently, the petitioner's title. The petitioner thereafter submitted separate online applications dated 10.11.2025, seeking a survey of the subject property and the transfer of patta. Despite the lapse of considerable time, the respondents have failed to act on the same. Aggrieved by this inaction, the petitioner has filed the present Writ Petition seeking a direction to the respondents to measure and survey the subject property in accordance with law and consequently transfer the patta in his favour. 3. Heard the learned counsel for the petitioner, Mrs.Inthu Karunakaran, learned Government Advocate for the respondents 1and 2 and Mr.Durai Gunasekaran, learned Government Advocate (Crl.Side) for the respondent 3. 4. Considering the facts and circumstances of the case and the submissions made on either side, this Court directs respondent Nos. 1 and 2 to consider the petitioner's applications dated 10.11.2025, conduct a survey of the subject property, and fix the boundary stones within a period of six (6) weeks from the date of receipt of a copy of this order. __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 24116 of 2026 5. Respondent No. 2 is further directed to consider the petitioner's application for transfer of patta on its merits and pass appropriate orders in accordance with law. This shall be done after verifying all relevant records, issuing prior notice to the petitioner as well as any other interested parties or counter-claimants, and taking into consideration all relevant orders passed by this Court and other competent Civil Courts. 6. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the 3rd respondent/ jurisdictional Police, and the 3rd respondent/jurisdictional Police are mandated to provide necessary police protection. 7. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. 6.
