In Re : Mubaswar Seikh @ Juel Sk & Ors. ...… petitioners Mr. Arka Kumar Nag Mr. Soham De Dhara Mr. Souvik Naiya Ms. Shrobana Sengupta …for the petitioners Mr. Bhaskar Seth Mr. Mukesh Kumar Gupta
…for the State
Petitioners stand implicated in a case of extortion. No criminal antecedents of the petitioners are brought to the notice of the Court. Materials in the case diary do not suggest a minimum requirement of custodial interrogation of the petitioners. In such circumstances, I deem it appropriate to grant anticipatory bail to the petitioners. Accordingly, I direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 482 (2) of the B.N.S.S.,
2023. The petitioners will report before the Investigating Officer
2 once a month till the conclusion of the investigation. The petitioners shall appear on every date before the Jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioners in Court including cancelling the anticipatory bail granted without further reference to this Court. This application for anticipatory bail is, thus, allowed.
