Mr. Arvind Kumar Sharma, learned counsel for the petitioner. 2. Mr. Rajeev Singh Bisht, learned Additional C.S.C. for the State of Uttarakhand. 3. Petitioner claim for compassionate appointment was rejected on the ground that his mother was in State service on the date of the death of his father. 4. It is not in dispute that petitioner’s father was employed as Group ‘D’ employee in Health Department in District Pauri Garhwal, who died on 31.05.2010. On the date of death of petitioner’s father, petitioner’s mother was employed as SAFAR KARMI, who retired in the year 2023. Thus, the application made by petitioner is hit by Rule 5 of Recruitment of Dependants of Government Servants Dying in Harness Rules, 1974. 5. Learned State Counsel relies upon judgment rendered by this Court in WPSS No. 2240 of 2025 and submits that identical issue has been dealt with in that judgment. 6. Learned counsel for the petitioner concedes that the issue involved is identical to the one decided in WPSS No. 2240 of 2025. 7. Accordingly, the writ petition is 2026:UHC:1433 decided in terms of judgment dated 05.01.2026 rendered in WPSS No. 2240 of 2025.
