Tiwari Ms. Aparajita Mitra …for the State in WPA 23414 of 2026 1. The petitioners in WPA 16050 of 2026 prayed for a direction upon the respondent authorities, particularly the respondent No.6 to grant permission to organize Central Park Sorbojanin Durga Puja for the year 2026 at B-8, Civic Centre Ground, Kalyani. 2 2. Learned counsel appearing for the petitioners submits that since the year 2008 the committee is applying for grant of permission and accordingly the authorities have time to time granted permission for performing Durga Puja in the said premises. This year also the petitioners have applied for grant of permission but in the mean time, there was an objection from the petitioner of WPA 23414 of 2026. The claim of the petitioner of WPA 23414 of 2026 is that in the year 2025 they have constituted a trust and a trust deed was executed consisting of seven trustees and in the month of July, 2025 the trust was registered and in September, 2025 the authorities have granted permission to the said trust under the name of Central Park Sarvajanin Sri Sri Durga Puja Committee. The petitioner of WPA 23414 of 2026 is claiming the exclusive right to perform puja and has prayed for a direction upon the authorities to grant permission to the petitioner exclusively at B-8, Civic Centre Ground, Kalyani. 3. When the authorities found that there is a dispute between two rival groups to perform puja, the Sub- Divisional Officer held a meeting on July 10, 2026 at 7 pm in the Conference Room of the Office of the Sub- Divisional Officer, Kalyani. In the said meeting, the representatives of both the groups were present along with the Hon’ble MLA, Kalyani Assembly Constituency; Inspector-in-Charge, Kalyani Police Station and other officials concerned. After taking into consideration, the 3 Sub-Divisional Officer, Kalyani has advised to both the groups to organize the puja strictly in accordance with the applicable laws, rules and guidelines issued by the Government from time to time and to extend full cooperation to the administration in maintaining public order. 4. The petitioner in WPA 23414 of 2026 being aggrieved with the said proceeding has filed the present writ application and prayed for quashing of the said proceeding. 5. Learned counsel appearing for the State submits that though both the parties are fighting against each other for performing the Durga Puja at Kalyani but none of the parties have applied under the Sahaj Portal for performing the Durga Puja. He has handed over the Notification, wherein the authorities have decided to reopen the portal on October 7, 2026 from 10 am to 4 pm. Learned counsel for the State submits that if both the parties apply for grant of permission for performing Durga Puja under the said portal, the authorities will consider the same and pass appropriate order. 6. Considering the submissions made by the learned counsel for the parties, this Court finds that there is a dispute between two groups to perform Durga Puja at B-8, Civic Centre Ground, Kalyani, a permission is also required from the State Manager, Kalyani, Urban Development and Municipal Affairs Department. 4 7. This Court further finds that since the year 2008 the petitioners of WPA 16050 of 2026 are performing Durga Puja. Now the petitioner in WPA 23414 of 2026 has registered a trust deed consisting of seven trustees. 8. The Sub-Divisional Officer, Kalyani is directed, if any request is received from both the groups through the Sahaj Portal on October 7, 2026, to hold a meeting with the two rival groups of the parties in the presence of the Superintendent of Police, Ranaghat Police District and State Manager, Kalyani, Urban Development and Municipal Affairs Department and also to take into consideration that the petitioner in WPA 23414 of 2026 is only seven trustees but the petitioners in WPA 16050 of 2026 are the villagers, who have constituted a committee and performing Durga Puja since several years. The Sub-Divisional Officer and the other officers while considering the request of the parties to take into consideration for the best interest of the local people of the said area and to pass appropriate order for granting permission either of one of the parties or both the parties. The committee shall also take into consideration that any law and order problem should not arise and the authorities will take appropriate steps to maintain the law and order in the said area. 9. It is made clear that this Court has constituted a committee consisting the Sub-Divisional Officer, Kalyani; the Superintendent of Police, Ranaghat Police District and the State Manager, Kalyani, Urban 5 Development and Municipal Affairs Department to take a conscious decision so that Durga Puja shall be performed in the said area without any law and order problem. 10.
