For the State The petitioner is the President of Sanatan Aikya Manch, Asansol and intends to organise a religious and cultural programme named ‘Hindu Sammelan’ on 1st March, 2026 from 10 am to 6 pm in the ground belonging to Steel Authority of India Limited (hereinafter referred to as ‘SAIL’). Necessary permission for the same has been granted by SAIL by a letter issued on 7th February, 2026. However, the police authority has refused such permission. Learned counsel for the State submits that the permission may be accorded subject to stringent conditions. Upon consideration of the submission made on behalf of the parties, this Court directs that the petitioner is permitted to organise the programme on 1st March, 2026 from 10 am to 6 pm in the ground of SAIL subject to the conditions laid down by SAIL on 7th February, 2026. In addition, the petitioner shall abide by the following conditions: 1. Number of participants shall not be more than 2000 at any point of time. 2 2. Sound system shall be used within the permissible limits as prescribed by the Hon’ble High Court and West Bengal Pollution Control Board. 3. The programme shall be held in an absolutely peaceful manner and no inciteful or provocative speech shall be made. 4. The participants shall not disturb the public at large, passersby, traffic movement or the neighbourhood in any manner whatsoever. 5. The petitioner shall provide the names and mobile phone numbers of at least 20 volunteers who shall be responsible in the event of any untoward incident and shall maintain liason with the police authority. 6. Sufficient police personnel shall be deployed in and around the place in order to ensure maintenance of law and order. 7. The participants shall abide by the instructions given by the police personnel at the spot. 8. The participants shall disperse within 2 hours of completion of the programme. With the aforesaid observation and directions, the writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. 3 Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
