GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following: 4 THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION NO: 2771 OF 2026 ORDER:- The Petitioner is aggrieved by the inaction on the part of the Respondents No. 2 and 3 in granting permission for construction of a compound wall around the land admeasuring Ac.1.80 cents in Sy.No.67 situated at B.K.Pally Village, Madapanalli Municipality, Annamayya District. 2. Learned Standing Counsel for Respondent No.2 sought time to place on record the details of O.S.No.208 of 2018, which is filed for partition is pending. O.S.No.9 of 2019 filed by the Petitioner against three defendants seeking partition admeasuring Ac. 0.90 cents of land. 3. It is submitted that the Petitioner intends to construct a compound wall over entire extent of Ac. 1.80 cents. When the suit for partition is pending consideration for an extent of Ac. 0.90 cents permission could not be granted as the Petitioner cannot represent the defendants for their share and construct a compound wall for the entire extent of Ac. 1.80 cents. 4. In reply, learned counsel for the Petitioner submits that the compound wall is essential to protect the land from land grabbers near the area and that it is in the interest of the Petitioner as well as the defendants in the suit for partition that a compound wall is required to be constructed. 5. Considering the submissions, it is left open for the Petitioner and the defendants in O.S.No.9 of 2019 to submit a common application to the 5 Respondent No.2 for grant of permission for construction of a compound wall. On receipt of such application, complied the requirement for granting permission, the Respondent No.2 shall accord permission to the applicants. 6. With the above observation, the Writ Petition stands disposed of. There shall be no order as to costs.
