Notice. Mr. Rajat Chaudhary, learned Assistant Advocate General, appears and waives service of notice on behalf of the respondents.

This writ petition has been filed for the grant of following substantive reliefs: -
“(ii) That respondents may be directed to take a decision for allotment of land in exchange to the petitioner and his brother in lieu of the land occupied by the respondents for constructions of road within a time bound period.
(iii) That in the alternative, the respondents may be directed that they should not deprive the rightful owners of their property without adopting due process of law and initiate proceedings for acquisition of land and for

payment of amount of compensation by invoking emergent provisions of contained in this regard under relevant existing law. (iv) That respondents be directed to pay use and occupation charges continuously for the last more than forty years, since when they are utilizing the land in question without adopting due process of law.”

Learned counsel for the petitioner submitted that petitioner would be content in case respondents are
directed to consider his case in terms of representation dated 14.08.2025 (Annexure P-14) within a fixed time schedule. Learned Assistant Advocate General is not averse to this prayer.

Having regard to the afore-submissions, but without examining the merits of the matter, this writ petition is disposed of with direction to the respondents / Competent Authority to consider and decide the case of the petitioner, in accordance with law, keeping in view his representation dated 14.08.2025 (Annexure P-14), within a period of eight weeks from today. The decision so arrived at shall also be communicated to the petitioner.
Pending miscellaneous application(s), if any, also to stand disposed of.
