This writ petition has been filed under Article 227 of the Constitution of India, whereby petitioners have sought a direction for setting aside the order dated 23.12..2025, passed by revisional court i.e., Additional District Judge, Kotdwar, Pauri-Garhwal in Civil Revision No.21 of 2025, whereby while registering the revision, no interim order was passed in favour of the petitioners fixing the case on 02.01.2026. 4. It is contended of learned counsel for the petitioners that the petitioners have filed a revision challenging the order dated 12.12.2025 in Execution Case No.7 of 2021, whereby the objection of the petitioners was rejected. 5. The revisional court has issued notice to the respondents and did not pass any interim order on the stay application moved by the petitioners. 6. Learned counsel for the petitioners submitted before this Court that on the next date fixed i.e., 02.01.2026 notice was served upon the respondents, but respondents did not put in appearance before the revisional court, but instead of passing any order on the stay application the matter was fixed for 19.01.2026, awaiting the respondents to put in appearance. 7. Now the counsel for the petitioners wants this Court to pass an interim order till disposal of the stay application. 8. In the opinion of this Court such an order cannot be passed as it will influence the mind of the revisional court. 9. In such view of the matter, no interference is warranted in the matter under Article 227 of the Constitution of India. 10. Accordingly writ petition is dismissed on merits in limine.
