Heard the learned counsel for the petitioner and the learned Standing Counsel for Gram Panchayat. This Court, by an Order dated 15.05.2026, observed that any construction on the road margin will be contrary to the very law laid down by the Hon’ble Apex Court as well as a Full Bench of this Court in Sataraboyina Someswara Rao v. Sangasetti Tirupathamma reported in 1989 (1) ALT 36. It is further observed in the said Order dated 15.05.2026 that Sri Nithin, learned counsel, representing Sri M.Sudhir, learned Standing Counsel for respondent No.4-Gram Panchayat, on written instructions from the Panchayat Development Officer, Gram Panchayat, Nizampatnam, Nizampatnam mandal, submitted that the Gram Panchayat is not undertaking any construction on the road margin located between the petitioner’s shop in survey No.431/10 bearing D.No.1073/A and the northern public road situated within Nizampatnam gram panchayat limits. The written instructions are placed on record. Today, when the matter is taken up, the learned counsel reiterates same in his submissions. In view of the submissions made by the learned counsel appearing for official respondents and since the grievance of the petitioner has been redressed, the Writ Petition is closed.
