The case of the prosecution is that the petitioner, an elderly man, allegedly committed an act of indecent exposure before the victim girl and signalled her to come near him. 3. The learned counsel for the petitioner vehemently opposed the allegations, submitting that a civil property dispute exists between the victim’s parents and the petitioner, and that the present criminal complaint has been filed maliciously to settle scores. 4. The victim girl has spoken about the incident, and her statement was recorded under Section 164 of the Cr.P.C. This Court, in the exercise of its jurisdiction under Section 482 of the Cr.P.C. (or Section 528 of the BNSS), cannot conclusively decide upon the correctness of the petitioner's defense. The petitioner must raise all these grounds before the trial court, which is the appropriate forum to consider the same. In view thereof, this Criminal Original Petition stands dismissed. 29-06-2026 VCA Neutral Citation: No https://www.mhc.tn.gov.in/judis CRL OP No. 16311 of 2026 __________ Page3 of 4 To, 1.
