ORDER This Writ Petition has been filed challenging the impugned communication of the 2nd respondent dated 03.06.2026.

The learned counsel for the petitioner submitted that the petitioner is the title holder of the subject properties situated at Survey Numbers S.No. 68/ 11A to an extent of 0.18.0 Ares, S.No.68/ 12 to an extent of 0.6.0 Ares, S.No.68/13 to an extent of 0.7.00 Ares, S.No.68/14 to an extent of 0.5.50 Ares and S.No.109/1 to an extent of 6.75 cents, Punjai lands, the lands at S.No. 78/7 to an extent of 0.5.00 Ares and S.No.80/2 to an extent of 0.7.50 ares Nanjai lands, all comprised in Patta No. 216 and S.No. 97/5 to an extent of 0.09.0 Ares in Patta No.19 and has been in possession and enjoyment of the __________ Page2 of 6 https://www.mhc.tn.gov.in/judis
WP No. 24601 of 2026 same. Seeking the transfer of patta in her favour, she submitted an online application dated 20.05.2026. However, the first respondent rejected the said application on the ground that the petitioner's brother and sisters had raised objections to the transfer. Challenging the said order of rejection, the petitioner has approached this Court.
3. The primary grievance of the petitioner is that the impugned rejection
order was passed by the first respondent without conducting a proper field enquiry or affording her an opportunity of being heard. It is further contended that the impugned order is cryptic and non-speaking, passed in gross violation of the principles of natural justice, and is therefore liable to be set aside on this ground alone.
4. The learned Government Counsel appearing for the respondents fairly submitted that the matter may be remitted back to the first respondent for fresh
consideration, with a direction to pass appropriate orders after issuing due notice to all the parties concerned. __________ Page3 of 6 https://www.mhc.tn.gov.in/judis

5. Considering the facts and circumstances of the case and the
submissions made by the learned counsel on either side, this Court is of the view that the impugned rejection order was passed without conducting a proper enquiry and without affording a fair and reasonable opportunity to the petitioner to put forth her case. This constitutes a clear violation of the principles of natural justice.
6. Accordingly, the impugned communication dated 03.06.2026 passed by the first respondent is hereby set aside. Consequently, this Court inclines to remand the matter to the first respondent for fresh consideration, and the matter is accordingly remitted back to the first respondent. The first respondent is
directed to consider the application of the petitioner afresh, after issuing notice to the petitioner as well as the counter-parties, if any, and affording them an opportunity of a personal hearing.
7. The first respondent shall pass a reasoned speaking order on merits and in accordance with law, taking into consideration all relevant materials placed on record. If the application is otherwise found to be in order, the first __________ Page4 of 6 https://www.mhc.tn.gov.in/judis
WP No. 24601 of 2026 respondent shall effect the patta transfer within a period of eight (8) weeks from the date of receipt of a copy of this order.
