3. The present criminal misc. application is filed with a prayer to quash and set-aside the
order dated 04.05.2024 passed by the court of learned II Judicial Magistrate, Haridwar, District Haridwar in Complaint Case No. 1004 of 2024, whereby, the complaint filed by the applicant was dismissed and also the order dated 06.10.2025 passed by the court of learned 4th Additional District Judge, Haridwar, District Haridwar whereby Criminal Revision No. 153 of 2024 was also dismissed.
4. Heard learned counsel for the parties and perused the record.
5. As the applicant earlier filed the FIR and after investigation, the Investigating Officer have filed the final closure report, against which, the applicant also filed protest petition and the court dismissed the protest petition. Thereafter, on the same set of facts, again a complaint was filed.
6. It is settled proposition of law that when the closure report has been filed in the FI R after investigation and protest petition too have been dismissed, then on the same set of
facts, complaint is not maintainable. Thus, this Court finds no infirmity or illegality in the impugned order dated 04.05.2024 passed by
the court of learned II Judicial Magistrate, Haridwar, District Haridwar in Complaint Case No. 1004 of 2024 and also in the order dated 06.10.2025 passed by the court of learned 4th Additional District Judge, Haridwar, District Haridwar in Criminal Revision No. 153 of
2024. Hence, this Court does not find any reason to interfere with the impugned orders.
7. Accordingly, the criminal misc. application fails and is hereby dismissed.
