30-09-2026 Item No.27 Subrata Bhattacharyya AR(C) IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction Appellate Side WPA No.15112 of 2026 Subrata Ruj -vs- The State of West Bengal & Ors. Mr. Md. Manuwar Ali Ms. Nandita Kundu Mr. Aniruddha Roychoudhury …for the petitioner Mr. Anirudhya Dutta Mr. Anujit Mookherji …for the State 1. The grievance of the petitioner is that he has not been paid his higher scale of pay in terms of the direction passed by the Additional District Inspector of Schools (SE), Durgapur Sub-Division, Paschim Bardhaman dated November 20, 2019. 2. As per the communication of the ADI of Schools dated November 20, 2019, the petitioner has been accorded higher scale of pay with effect from November 6, 1997; but the petitioner is being paid the higher scale of pay only from August 1, 2021. 3. Prayer has been made to direct the respondents to pay the arrear enhanced remuneration for the period from November 6, 1997 till July 31, 2021. 4. Learned counsel for the State submits that some necessary documents, including proper computation, were sought by the DI of Schools from the school; but the same has not been forwarded by the school till date. 5. Upon hearing the submissions made on behalf of both the parties and on perusal of the documents annexed to the writ petition, as it appears that the higher scale of pay of the petitioner has already been allowed with effect from November 6, 1997, the authority ought to have ensured that the payment of higher remuneration is actually made from the specified date. The petitioner alleges that he has been receiving his higher scale of pay only from August 2021 and that arrears are due. 6. In that view of the matter, the District Inspector of Schools (SE), Durgapur Sub-Division, Paschim Bardhaman is directed to take prompt necessary steps for payment of the arrear enhanced remuneration of the petitioner for the period from November 6, 1997 till July 31, 2021 without any further delay and ensure that the arrears are disbursed positively by December 31, 2026. 7. The subject school – the fifth, sixth and seventh respondents herein – is directed to cooperate with the DI of Schools and forward all necessary documents and computation to the DI of Schools for compliance of the direction passed hereinabove. 8. In the event the school does not forward the documents to the DI of Schools, the DI shall take steps for collection of necessary documents from the school so that the direction passed hereinabove is complied with in letter and spirit. 9. The writ petition is disposed of. 10. All parties are to act on the server copy of this order duly downloaded from the official website of this Court. 11. Certified server copy of this order, if applied for, shall be made available to the parties. [Amrita Sinha, J] 2 3
