The Court made the following: ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused on bail in Crime No.197 of 2025 of Tada Police Station, Tirupati District, registered against the Petitioner/Accused herein for the offences punishable under Sections 103(1), 118(1), 126(1) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS). 2. Mr.Sivaprasad Reddy Venati, the learned counsel for the Petitioner, submits that the Petitioner is innocent of the alleged offence and he has been falsely implicated in the alleged offence. He has not committed any offence. He is law-abiding citizen. He has got fixed abode. The Petitioner undertakes to abide by any conditions that this Court may impose while granting bail to the Petitioner. Therefore, he prays that the present petition be allowed. 3. Per contra, Mr.K.Sandeep, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioner and submitted that though the charge sheet has already been filed in the case, the accusations against the petitioner are well founded. 4. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 5. As seen from the record, this is the second bail application filed by the petitioner/Accused. A Coordinate Bench of this Court, in Crl.P.No.2610 of 2026, dismissed the earlier bail application. The charge sheet has been filed. The accusations against the petitioner are well founded. There is no change in circumstances from the dismissal of the earlier bail application till the filing of the present successive bail application. 6.
Having regard to the recorded complicity of the petitioner in the commission of the offence, the facts and circumstances of the case, and the nature of the evidence available on record, this Court is not inclined to enlarge the petitioner/Accused on bail at this juncture. Accordingly, the Criminal Petition is liable to be dismissed
