For Petitioner(s): Mr.N.Venkatesan For Respondent(s): Mr.R.Rajasekaran Government Advocate (Criminal Side) for R1 ORDER This Criminal Original Petition seeks to quash the FIR in Crime No.453 of 2025 on the file of the first respondent / the Inspector of Police, K-8, Arumbakkam Police Station, Arumbakkam, Chennai, for alleged offences under Sections 296(b), 329(3), 333, 351 (3), 79 of BNS read with Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002, on the ground of compromise between the parties. The parties are present before the court and, on examination, stand by their compromise and do not want the case to proceed further. 2. The broad contours of the High Court's power to exercise extraordinary jurisdiction under Section 482 of the Cr.P.C. and Section 528 of the BNSS in https://www.mhc.tn.gov.in/judis CRL OP No. 16915 of 2026 __________ Page3 of 5 respect of compromise of non-compoundable offences are laid down by the Hon’ble Supreme Court of India in Gian Singh -Vs- State of Punjab and Another (2012 10 SCC 303) and other subsequent judgments. 3. The gist of facts leading to the instant case is that the defacto complainant and the accused are neighbours. The occurrence arose out of a dispute between the neighbours, and the case was registered for the offences under Sections 296(b), 329(3), 333, 351 (3), 79 of BNS read with Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002. Subsequently, the parties have amicably resolved their differences and are now living peacefully in the locality. In view of the settlement arrived at between them, they have sought to quash the proceedings on the basis of compromise. Both the defacto complainant and the accused are present before this Court. 4.
