Upon considering the averments contained in the F.I.R, it is seen that the defacto complainant and her husband after seeing the information from NITHRA App contacted the accused persons who were conducting themselves in the name of Former Development Agricultural Co-operative Society and they proposed a scheme by which they asked the defacto complainant to deposit the amount and in tune with their deposit and as per the educational qualification promised to secure a clerical job and also return in tune with their deposit. After getting such deposit from the defacto complainant and similarly situated persons the accused had cheated the innocent depositors. Hence, the FIR. 3. The case of the present petitioner namely Rama @ Rama Bhagya Prakash is that she is neither associated with the other accused who are conducting the said affairs nor she was an employee merely she was present at the scene when the day defacto complainant came, the defacto complainant wrongly misunderstood her also she is also an employee and also given the complaint. The counsel for Government of Tamil Nadu appearing on behalf of the Government of Tamil Nadu would submit that there are number of victims and investigation is proceeding and it is the case of the prosecution that the petitioner herein is also the agent who indulged in collecting money from the victims. He further submits that if 3 months time is granted the investigation will be completed and final report is filed. 5. Whether the petitioner is totally unconnected to other persons who committed the fraud and was merely present or she is an employee who was also also working in tandem with other accused and collecting money will all come only in the course of investigation. When the concern has indulged in the fraud and when the defacto complainant has mentioned who are all present in the site as accused and on behalf of the prosecution it is contended that the petitioner is an agent, at the stage of entertaining the quash application, this Court cannot decide the issue and it is a fact which has to be established during the course of investigation and thereafter in the Trial. If only the respondent police filed a charge sheet without any material against the petitioner, then the petitioner will have an appropriate cause of action. Therefore, keeping open the liberty of the petitioner to contest the issue, if the charge sheet is filed without any material against the petitioner. In view thereof, this Criminal Original Petition to disposed of. Consequently the connected miscellaneous petition is closed.
