SL. No Date Office Notes, reports, orders or proceedings or directions and Registrar’s order with Signatures COURT’S OR JUDGES’S ORDERS WPMS No. 88 of 2026 Hon’ble Rakesh Thapliyal, J. 1. Mr. B.S. Adhikari, learned counsel for the petitioner. 2. Mr. Ganesh Kandpal, learned Deputy Advocate General with Mr. Tarun Mohan, learned Brief Holder for the State. 3. Mr. Sandeep Kothari, learned counsel for the respondent no. 3. 4. By the instant writ petition, petitioner is praying for the following relief: “A writ order or direction in the nature of Mandamus commanding the respondents to take a decision on the representation dated 22.12.2025 (Annexure 5) of the petitioner.” 5. Learned counsel for the petitioner submits that petitioner is a senior citizen of 89 years of age. He was allotted a house on 10.11.1971 and since then residing there. There is Government Order dated 24.06.2000, pursuant to which, petitioner applied for free hold the house, which was allotted to him and thereafter, he also deposited a sum of Rs. 13,15,939/- towards free hold but respondent authorities are sleeping over the matter. 6. Mr. Sandeep Kothari, learned counsel for the respondent no. 3 has not disputed this fact that the application of the petitioner is still pending for consideration. 7. Since petitioner has already deposited Rs. 13,15,939/- with the respondent authorities for the purposes of free hold the house, therefore, respondents are under legal obligation to take decision in the matter. 8. Accordingly, present writ petition is disposed of with the direction to the respondent authorities to expedite the free hold proceedings by taking decision by reasoned and speaking order, and also by giving opportunity of hearing positively within a period of one month from the date of production of certified copy of this order.
