Affidavits filed by the parties are taken on record. 2. The petitioner is aggrieved that his date of birth, which he had initially, at the time of joining the employment given as 1964, has not been subsequently changed by the employer to 1967. 3. The petitioner has made several attempts to change his date of birth, which he magically found to be 1967 pursuant to a NRC investigation. It was only in 2020 that he was issued a fresh birth certificate by which the date of birth was shown to be 04.02.1967. This certificate along with Aadhaar Card, the school leaving certificate as well as the admit card all reflect his date of birth to be 1967, being duly amended, pursuant to the fresh birth certificate. 4. Mr. Roy Mukherjee, appearing for the respondent nos. 2 and 3 submits that the employer has made investigation and inspection and found from the teacher- 2 in-charge of the petitioner’s school that the admission register in which the date of birth of the petitioner has been shown as 04.02. 1967 bears overwriting and is a suspected document. 5. However, Mr. Roy Mukherjee is ad idem with the proposition from this Court that a document, however suspect and questionable, till it is set aside by a court of competent jurisdiction cannot simply be ignored. 6. The birth certificate of the petitioner is one of such documents. 7. In view of the fact that the petitioner is retiring on 27.02.2026, I direct the respondent no. 3 to consider the case of the petitioner regarding his change of birth from 1964 to 1967 in light of the birth certificate, the school leaving certificate as amended as well as the Aadhaar Card and the identity card from the Election Commission of India, all of which have been amended. The said respondent is directed to consider and dispose of this issue by 24.02.2026. The respondent no. 3 will intimate the result of the consideration to the petitioner by 25.02.2026. 8. With the aforestated directions, the present writ petition is disposed of. 9. There shall be no order as to costs. 3 10.
