No.11763 of 2026 ORDER : The Court made the following order :- The petitioner/Accused No.4, who was arrested and remanded to judicial custody on 22.11.2024 for the alleged offence under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(2)(a) of NDPS Act, 1985 in Crime No.1 of 2025 on the file of the respondent police, seeks bail. 2. The allegation against the petitioner is that the petitioner joined hands with the other accused transported 334.313 kgs of ganja from Andhra Pradesh to Tamil Nadu in a lorry fitted with a secret chamber. On prior information, the respondent police intercepted the lorry along with a car that was following it for the purpose of transporting and unloading the contraband. Immediately thereafter, the police party, after complying with the mandatory provisions, recovered the contraband as well as the vehicles used for the commission of the offence. Hence, the complaint was registered and the petitioner was arrested. 3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent, he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. 2/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.11763 of 2026 The petitioner is ranked as A2. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. He further submit that one of the co-accused namely, Piramuraj was released on bail by this Court in Crl.O.P.(MD).No.7430 of 2026, by order dated 10.06.2026 and therefore, he is entitled to bail on the ground of parity. 4. The learned Counsel for State of TN (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that Section 37 of NDPS Act is applicable in the present case. Though the co- accused was released on bail, he submitted that the bail was granted on the ground that no recovery was made from him. He further submitted that no grounds have been made out to satisfy the requirements under Section 37 of the NDPS Act. Hence, he opposed the grant of bail to the petitioner. 5.Heard both sides and perused the materials available on record including the final report and other connected materials. 6.A perusal of the records reveals that all the accused had 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.11763 of 2026 originated and organised the transportation of ganja from Andhra Pradesh to Sri Lanka. It is further revealed that the vehicles used for the transportation with fake registration numbers. The accused were arrested along with the contraband while unloading the same and were found to be in conscious possession of the contraband. A huge quantity of contraband was recovered and therefore, Section 37 of the NDPS Act is applicable to the present case. In such circumstances, there are no grounds to grant bail to the petitioner. Hence, I am not inclined to grant bail to the petitioner at this stage. 7.Accordingly, this Criminal Original Petition stands dismissed.
