05.10.2026 205. Bd. (Disposed of) Calcutta High Court Ct.05 In the Circuit Bench at Jalpaiguri Appellate Side C.R.R. 405 of 2026 Raghubir Suri @ Rajat -vs- The State of West Bengal Mr. Arnab Saha Md. Shoaib Aktar Ms. Mamataj Khatun …for the Petitioner In this application petitioner has assailed the order dated 28.11.2025 by which the warrant of arrest has been issued against the petitioner. Being aggrieved by the aforesaid order, learned counsel for the petitioner submits that the petitioner had reposed complete faith and confidence in his learned advocate and had no independent knowledge of the procedural developments in the case but he is now being made to suffer the serious and coercive consequence of warrant of arrest for no deliberate conduct attributable to him. However, learned counsel appearing on behalf of the petitioner makes an innocuous prayer that he may be given liberty to surrender before the court below. Having heard learned counsel appearing on behalf of the petitioner it appears that the prayer made by the petitioner is innocuous and, if it is allowed in terms of the prayer made therein the opposite party will have no 2 cause to prejudice and as such service of copy of application upon the opposite party is dispensed with. Having considered the submissions made on behalf of the petitioner, the instant application being CRR 405 of 2026 is hereby disposed of giving liberty to the petitioner to surrender before the court below within a period of two weeks from date and in the event of such surrender the court below will dispose of his prayer in accordance with law, without being influenced by any observation made herein. The impugned order by which the court below had issued warrant of arrest against the petitioner dated 28.11. 2025 shall remain stayed for a period of two weeks or till the petitioner surrenders before the court below, whichever is earlier. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
