NO.26 OF KUNDURU VILLAGE, HUTHRIDURGA HOBLI, KUNIGAL TALUK AND ETC., THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents. 2. It is the contention of the petitioner that his grandfather Narsigowda @ Kataiah was granted 2 acres of land in Sy.No.26 of Kunduru Village, Huthridurga Hobli, Kunigal Taluk, in terms of the order bearing No.L.N.D.RUC. 338/1959-60 dated 30.10.1960 and his name was entered in the revenue records. Subsequently, by way of mutation order bearing M.R.No.12/1974-75 the khata was transferred in favour of Sri Narsigowda’s son Venkatappa i.e., the father of the petitioner herein. However, after - 3 - HC-KAR NC: 2026:KHC:5348 WP No. 2638 of 2026 computerization, the name of the petitioner’s father was not continued in the RTC. The prayer in the writ petition is to issue a writ of mandamus directing respondent No.4- Tahsildar, Kunigal Taluk, to consider the representation at Annexure ‘H’ given by the petitioner to restore the name of the petitioner’s father in the computerized RTC and thereafter consider the entry of the name of the petitioner or the legal heirs of late Sri Venkatappa in the revenue records. 3. After hearing the learned counsel for the petitioner, the learned High Court Government Pleader and on perusing the petition papers, this Court finds from the material on record that the name of the petitioner’s father was earlier entered in the land revenue records. However, if the Tahsildar is of the opinion that the petitioner’s grandfather has not been granted lands, it is the duty of the Tahsildar to secure the original grant records, Saguvali Chit issue register and other contemporaneous records to satisfy himself regarding the grant made in favour of the - 4 - HC-KAR NC: 2026:KHC:5348 WP No. 2638 of 2026 petitioner’s grandfather. Moreover, there is no reason why the name of the petitioner’s father which was earlier entered in the land revenue records has not been continued after computerization. The Tahsildar is duty bound to look into all these aspects and pass necessary orders. 4. Consequently, this writ petition stands disposed of with a specific direction to respondent No.4 - Tahsildar, Kunigal Taluk to consider the representation given by the petitioner and in the light of the observations made hereinabove, verify the original records in the presence of the petitioner and pass necessary orders to enter the name of the petitioner’s father in the computerized RTC and land revenue records. Thereafter, the respondent-Tahsdilar shall look into the aspect of the legal heirs of Sri Venkatappa and after giving an opportunity of hearing to all the concerned parties proceed to enter the name of the petitioner along with any other legal heirs of Sri Venkatappa, as the case may be, in the - 5 - HC-KAR NC: 2026:KHC:5348 WP No. 2638 of 2026 computerized RTC and land revenue records in accordance with law. The entire exercise shall be completed as expeditiously as possible and at any rate within a period of two months from the date of receipt of a certified copy of this order. 5.
