Although the matter is coming up for preliminary hearing, with the consent of the learned counsel for petitioner and the learned Additional Government Advocate, the matter is taken up for final disposal. 3. It is the contention of the petitioner that he being the rightful owner of the property i.e., 4 acres and 10 guntas in Survey No.161 of Kommasandra Village, Sarjapura Hobli, Anekal Taluk, sought for phodi of the lands. However, objections were raised from some persons - 3 - HC-KAR NC: 2026:KHC:5293 WP No. 2407 of 2026 who contend that they are the legal heirs of late Smt. Eramma, whose name was reflected in the revenue records from the year 1968-69 to 1979-80. Consequently, the phodi proceedings were not conducted. Therefore, the prayer in the writ petition is to issue a writ of mandamus directing the respondent No.2 to consider the representation dated 23.09.2025 and legal notice dated 30.10.2025 issued by the petitioner and furnish information as to on what basis the name of Smt.Eramma was reflected in the revenue records of the year 1968-69 to 1979-80. 4. Having regard to the contentions raised by the petitioner, this Court is of the considered opinion that there is no cause of action for the petitioner to have filed this petition more-so without impleading the said persons who raised objections to the phodi proceedings. The petitioner on the other hand should have questioned the action of the 2nd respondent - Tahsildar and the Assistant Director of Land Records in not proceeding with the phodi - 4 - HC-KAR NC: 2026:KHC:5293 WP No. 2407 of 2026 at the request made by the petitioner who is entitled to seek such phodi, since his name is reflected in the RTC. 5. With these observations, the writ petition stands disposed of. 6. Learned Additional Government Advocate is permitted to file his memo of appearance within a period of four weeks from today.
