JUSTICE SANGEETA SHARMA Order 06/03/2026 1. The present bail application is de-tagged from S.B. Criminal Misc. Bail Application No.1581/2026. 2. This bail application has been filed on behalf of the accused- petitioner under Section 483 of B.N.S.S. in connection with FIR No. 221/2020 registered at Police Station Bari Sadar, District Dholpur, for the offence(s) under Section(s) 147, 148, 149, 332, 353, 307, 400 and 216-A of IPC and Section 3/25 of Arms Act and Section 11 of Rajasthan Dacoity Affected Area Act, 1985. 3. Learned counsel for the petitioner submits that for the first time, petitioner has failed to appear in the Trial Court and his bail bonds were forfeited on 01.07.2024. Learned counsel also submits that the petitioner is in judicial custody since 17.02.2026. Learned counsel further submits that the petitioner shall appear before the learned Trial Court on each and every date as fixed by the Court, [2026:RJ-JP:9709] (2 of 2) [CRLMB-3509/2026] therefore, in the interest of justice, the bail application of the petitioner may be allowed. 4. Per contra, learned Public Prosecutor vehemently opposes the submissions made by learned counsel for the petitioner hereinabove and submits that petitioner is absconding from last two years. 5. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the petitioner that the petitioner is in judicial custody since 17.02.2026. Without expressing any opinion on the merits/demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 6. Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Narayan Singh S/o Shri Badri Gurjar is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred on all subsequent dates of hearing and as and when called upon to do so. 7.
