JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question orders dated 20.08.2025 and 09.03.2026 passed under Section 82 of Code of Criminal Procedure, 1973, issuing proclamation against the petitioner for non-appearance and treating him as proclaimed offender in SPL.C.No.5097/2021 on the file of II Additional District & Sessions Judge, Kodagu. 2. Learned counsel for the petitioner submits that the next date of listing before the concerned Court is 09.06.2026 and the petitioner shall appear before the concerned Court on the next date. 3. In that light, subject to the said condition, the order of proclamation shall remain suspended. In the event, the petitioner would not appear on the said date, the order of proclamation would stand resurrected and the concerned Court shall pass necessary orders in accordance with law. - 3 - HC-KAR NC: 2026:KHC:21607 CRL.P No. 5934 of 2026 4.
