No.10472 of 2026 ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 21.05.2026 for the alleged offence under Sections 8(c) r/w 20(b)(ii)(B) of NDPS Act, 1985 in Crime No.95 of 2026 on the file of the respondent police, seeks bail. 2. The case of the prosecution is that the petitioner was found in illegal possession of 5 kgs of Ganja. Hence, the complaint has been registered and the petitioner was arrested on 21.05.2026. 3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent, he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. He further submitted that the petitioner is incarceration from 21.05.2026 and the quantity involved in this case is a intermediate quantity and Section 37 of the NDPS Act is not applicable to this case. The learned Counsel for State of TN (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the petitioner illegally trafficked 5 Kgs of Ganja. He further submitted that the petitioner has 11 previous cases, which are similar in nature. Hence, he opposed to grant bail to the petitioner. 5. Heard both sides and perused the materials available on record including the FIR. 6. Considering the facts and circumstances of the case and also considering the fact that the petitioner is having 11 previous cases, which are similar in nature and there is no ground to grant bail to the petitioner, hence, i am not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition stands dismissed.
