CRL OP(MD). No.12622 of 2026 PRAYER :- C-33AB. For Anticipatory Bail in Cr.No.157 of 2026 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused No.2, who apprehends arrest at the hands of the respondent for the offences punishable under Section 303(2) of BNS, 2023, r/w Sections 21(1) and 21(2) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.157 of 2026 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that, on 21.06.2026 at around 10.00 hours, the petitioner was found transporting one unit of river sand illegally quarried from the river area. When the police party intercepted the vehicle, the petitioner stopped the vehicle and fled from the spot. Thereafter, the police registered an FIR in Crime No.157 of 2026 against the vehicle.
3. The learned counsel for the petitioner would submit that the petitioner's name is not found in the FIR and he has been falsely 2/5 https://www.mhc.tn.gov.in/judis
CRL OP(MD). No.12622 of 2026 implicated in this case. He would further submit that no previous case is pending against the petitioner. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that the investigation is still pending and no one was arrested in this case so far and the sand was taken from the river area. He would further submit that the petitioner has no previous cases. However, he opposes to grant anticipatory bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. Considering the rival submissions made on either side and the nature of the offences alleged against the petitioner is that he along with other accused involved in illegal quarrying and transportation of river sand, thereby causing damage to the ecology and there is no grounds to grant anticipatory bail to the petitioner and hence, I am not inclined to grant anticipatory bail to the petitioner. 3/5 https://www.mhc.tn.gov.in/judis
